1. Introduction

This Privacy Policy ("Policy") describes how Makerise Innovations Private Limited ("Makerise", "MAKEVERY", "we", "us", "our") collects, uses, stores, shares, and protects personal data when you access or use makevery.in (the "Website"), our products, machines, firmware, software, mobile or desktop applications, and any related services (collectively, the "Services").

This Policy is published in compliance with:

• The Digital Personal Data Protection Act, 2023 ("DPDP Act") and rules made thereunder;
• The Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules");
• The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent applicable.

This Policy does not require any physical or digital signature and is a legally binding electronic record generated by a computer system.

By accessing the Website or using the Services, you consent to the practices described in this Policy. If you do not agree, please do not use the Website or the Services.

2. Who We Are

For the purposes of the DPDP Act, Makerise Innovations Private Limited acts as the Data Fiduciary in respect of personal data collected through the Services.

3. Definitions

• "Personal Data" means any data about an individual who is identifiable by or in relation to such data.
• "Data Principal" means the individual to whom the Personal Data relates (i.e., you).
• "Processing" means any operation performed on Personal Data, including collection, storage, use, sharing, or erasure.
• "Data Processor" means any person who processes Personal Data on our behalf.
• "User Content" means CAD files, STL/STEP/G-code files, toolpaths, slicer profiles, material recipes, images, and other materials you upload, transmit, or store through the Services.

4. Personal Data We Collect

4.1 Data You Provide Directly

• Name, email address, phone number, postal/shipping/billing address
• Organisation name, designation, GSTIN, and business contact details
• Account credentials (username and hashed password)
• Order, invoice, warranty registration, and service-request details
• Enquiry, demo request, quotation, and support ticket contents
• Recruitment data (CV, education, work history) if you apply for a role
• Any other information you voluntarily submit through forms, email, chat, or calls

4.2 Data Collected Automatically

• IP address, device identifiers, browser type and version, operating system
• Pages visited, referring URLs, clickstream, session duration, and access timestamps
• Cookies and similar tracking technologies (see Section 7)
• Approximate location derived from IP address

4.3 Product, Machine, and Telemetry Data

Where you use a MAKEVERY machine, firmware, or connected software that transmits data to us, we may collect:

• Machine serial number, firmware and software version, and configuration settings
• Print job metadata (duration, material type, temperatures, feed rates, failure codes)
• Diagnostic logs, error traces, sensor readings, and calibration data
• Consumable and usage statistics

We collect this data to provide warranty support, diagnose faults, improve product reliability, and develop our technology. Where technically feasible, telemetry is collected in de-identified or aggregated form.

4.4 Payment Data

Payments are processed by third-party payment gateways. We do not collect, store, or have access to your full card number, CVV, UPI PIN, or net-banking credentials. We receive only transaction status, a masked instrument identifier, and reference numbers.

4.5 Sensitive Personal Data

We do not intentionally collect sensitive personal data (such as biometric, health, or financial account information) except where strictly necessary and with your explicit consent, or where required by law.

5. Purposes for Which We Process Personal Data

We process Personal Data for the following purposes:

1. To create, authenticate, and administer your account
2. To process, fulfil, ship, invoice, and support orders for machines, materials, spares, and services
3. To provide technical support, warranty service, installation, training, and maintenance
4. To respond to enquiries, demo requests, quotations, and correspondence
5. To improve, troubleshoot, and develop our products, firmware, toolpath software, and Services
6. To conduct research, analytics, and quality control on an aggregated or de-identified basis
7. To send transactional communications (order confirmations, shipping updates, service notices, security alerts)
8. To send marketing and product communications where you have opted in (you may withdraw consent at any time)
9. To detect, prevent, and investigate fraud, misuse, security incidents, and violations of our Terms
10. To comply with applicable law, tax and regulatory filings, audits, and lawful requests from authorities
11. To establish, exercise, or defend legal claims
12. To evaluate applications for employment or internship

5.1 Basis of Processing

We process Personal Data on the basis of your consent, and for certain legitimate uses permitted under Section 7 of the DPDP Act, including where you voluntarily provide data for a specified purpose, for compliance with law or court orders, and for responding to medical emergencies or threats to safety.

You may withdraw your consent at any time by writing to contact@makevery.in. Withdrawal will not affect the lawfulness of processing carried out before withdrawal, and may limit our ability to provide certain Services. Where processing is required by law or for the fulfilment of an existing contractual or warranty obligation, we may continue to retain and process the relevant data.

6. User Content and Confidentiality of Design Files

We understand that CAD models, toolpaths, and process parameters may constitute your confidential information or trade secrets.

• We do not claim ownership of User Content you upload to or transmit through the Services.
• We access User Content only where necessary to provide the Services you have requested (for example, to diagnose a failed print or to generate a quotation) or where required by law.
• We will not disclose User Content to third parties except to Data Processors bound by confidentiality obligations, or as required by law.
• You are responsible for maintaining your own backups. We are not a backup or archival service and do not warrant the availability, integrity, or retention of any User Content.
• Do not upload User Content that is export-controlled, classified, subject to third-party confidentiality restrictions, or unlawful, unless you have all necessary authorisations.

7. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Website, remember preferences, maintain sessions, and measure usage.

You may block or delete cookies through your browser settings. Disabling strictly necessary cookies may prevent parts of the Website from functioning.

We currently use a limited number of third-party services — including payment processing, and, where enabled, website analytics — to operate the Website. Each such provider processes data under its own privacy policy.

8. Sharing and Disclosure of Personal Data

We do not sell your Personal Data.

We may share Personal Data with:

1. Data Processors and service providers — hosting, cloud storage, CRM, email, analytics, payment gateways, logistics and courier partners, and IT support vendors, engaged under contract and bound to process data only on our instructions;
2. Professional advisers — chartered accountants, company secretaries, lawyers, auditors, and insurers;
3. Investors and diligence parties — on a confidential basis, in aggregated or de-identified form, and only as reasonably necessary;
4. Government and regulatory authorities — where required by law, court order, or lawful request;
5. Successors in a business transaction — in connection with any merger, acquisition, restructuring, financing, or sale of assets, subject to this Policy continuing to apply;
6. With your consent — for any other purpose disclosed to you at the time.

9. Cross-Border Transfer

Some of our Data Processors may store or process data on servers located outside India. Where such transfer occurs, it will be to countries not restricted by the Central Government under the DPDP Act, and we will require the recipient to maintain safeguards substantially equivalent to those described in this Policy. By using the Services, you consent to such transfer.

10. Data Retention

We retain Personal Data only for as long as is necessary for the purpose for which it was collected, or for such longer period as required under applicable law (including the Companies Act, 2013, the Income-tax Act, 1961, and GST legislation — typically up to eight (8) years for financial and transactional records).

Where retention is no longer required, we will erase or irreversibly anonymise the data. Aggregated and de-identified data that cannot reasonably identify you may be retained indefinitely.

11. Security Measures

We implement reasonable security practices and procedures as contemplated under Section 43A of the IT Act and Rule 8 of the SPDI Rules, which include (as applicable): encryption in transit (TLS/HTTPS), access controls and role-based permissions, hashed credential storage, network firewalls, periodic backups, vendor due diligence, and internal confidentiality obligations.

However, no method of transmission or storage over the internet is completely secure. While we take reasonable steps to protect your data, we cannot and do not guarantee absolute security, and you transmit data to us at your own risk. In the event of a personal data breach, we will notify the Data Protection Board of India and affected Data Principals in the manner and within the timelines prescribed under applicable law.

12. Your Rights as a Data Principal

Subject to the DPDP Act and applicable law, you have the right to:

• Access — obtain a summary of the Personal Data we process about you and the processing activities undertaken;
• Correction and completion — have inaccurate or incomplete data corrected, completed, or updated;
• Erasure — request deletion of your Personal Data where retention is no longer necessary for the purpose or required by law;
• Grievance redressal — register a grievance with our Grievance Officer (Section 15);
• Nomination — nominate another individual to exercise your rights in the event of your death or incapacity;
• Withdraw consent — as described in Section 5.1.

To exercise any right, write to contact@makevery.in with sufficient detail to identify you and your request. We may seek verification of identity before acting. We will respond within the timelines prescribed under applicable law, and in any event within a reasonable period.

12.1 Your Duties

Under Section 15 of the DPDP Act, you must not impersonate another person, suppress material information, register a false or frivolous grievance, or furnish false particulars. Penalties may apply.

13. Children's Data

The Services are intended for persons 18 years of age or older. We do not knowingly collect Personal Data of children (persons under 18) or persons with disabilities having a lawful guardian, without verifiable consent of the parent or lawful guardian. We do not undertake tracking, behavioural monitoring, or targeted advertising directed at children. If you believe a child's data has been provided to us, contact us and we will delete it.

14. Third-Party Links and Services

The Website may contain links to third-party websites, marketplaces, open-source repositories, or services. We do not control and are not responsible for the privacy practices, content, or security of such third parties. Your use of those services is governed solely by their own terms and privacy policies. We encourage you to review them.

15. Grievance Officer

In accordance with the IT Act, the SPDI Rules, the IT Rules 2021, and the DPDP Act, the contact details of the Grievance Officer / Data Protection Contact are:

Grievances will be acknowledged within 24 hours and resolved within fifteen (15) days of receipt, or such other period as prescribed by law.

If you are not satisfied with our response, you may approach the Data Protection Board of India in accordance with the DPDP Act.

16. Limitation of Liability

To the maximum extent permitted by applicable law:

• We provide the Website and Services on an "as is" and "as available" basis and make no warranty that they will be uninterrupted, error-free, or free of harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or design files, arising out of or in connection with this Policy, the Services, or any unauthorised access to or alteration of your data by third parties.
• We are not liable for any breach, loss, or misuse arising from: (a) your failure to safeguard your credentials; (b) acts of third parties including hackers, processors, or payment gateways; (c) force majeure events; or (d) your own acts or omissions.
• Our aggregate liability in respect of all claims relating to Personal Data shall not exceed the amount actually paid by you to us in the six (6) months immediately preceding the event giving rise to the claim, or INR 5,000, whichever is lower.

Nothing in this Section excludes or limits liability that cannot lawfully be excluded or limited under Indian law, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or statutory penalties under the DPDP Act.

17. Changes to This Policy

We may amend this Policy at any time. The revised Policy will be posted on this page with an updated "Last Updated" date. Material changes will, where practicable, be notified by email or a prominent notice on the Website. Your continued use of the Services after such posting constitutes acceptance of the revised Policy.

18. Governing Law and Jurisdiction

This Policy is governed by the laws of India. Subject to the arbitration provisions in our Terms and Conditions, the courts at [Durg / Raipur], Chhattisgarh, India shall have exclusive jurisdiction over any dispute arising out of or in connection with this Policy.
